A post-marriage contract is a contract entered into after a couple`s marriage or life partnership. The agreement is a written contract detailing how goods and goods are distributed when the relationship ends in separation or divorce. It can also set provisions for the children of the relationship. The main advantage of a post-uptial agreement is of course to protect you and your spouse from costly legal proceedings in the future. Before the marriage, if a party does not like, the provisions contained in the proposed marriage arrangement and the couple is not able to reach an agreement, they may simply decide not to marry. With a post-uptial agreement, the couple is already legally bound and the spouses owe themselves a duty of trust. There is a concern that the provisions of a post-uptial agreement were not negotiated because a spouse had little choice but to sign the agreement. Even after the U.S. courts began to reject marriage unity as a legal theory, post-uptial ice contracts were seen as favoring divorce.  Many people have heard of marital agreements, but are surprised to learn that there is another type of similar legal document called a post-uptial agreement. There are exceptions to the rule that foreign courts generally have to comply with the existing agreement under existing legislation.
Article 31 of the Council`s 2016/1103 Regulation (EU) provides for a derogation in the EU legal system.  Under this regulation, the application of a provision of the law of a state mentioned in the regulation can only be refused if that application is manifestly inconsistent with the public policy of the forum. In the Polish legal system, there is a congruent regulation – Article 7 of the International Law on Private Law. Under this provision, foreign law does not apply if its application is contrary to the fundamental principles of the legal order of the Republic of Poland. Therefore, if the application of the agreement has an effect contrary to the fundamental principles of the legal order, the foreign rules that allowed the signing of the agreement will not be applied. Therefore, the agreement is not binding under Polish jurisdiction. As with any type of legal agreement, you should only enter into a post-uptial agreement after careful consideration of all the provisions and implications of the agreement.
